Welcome to vitamaps!
These Terms and Conditions ("Terms") govern your use of our app ("the App"). By using Vitamaps, you agree to comply with these Terms. If you do not agree to these Terms, please do not use the App.
1. Use of the app
By using the App, you agree to the following:
- You must be at least 13 years old to use the App. If you are under 13, you are not permitted to use the App.
- You agree to use the App only for lawful purposes and in accordance with these Terms.
- We reserve the right to suspend or terminate your access to the App at our discretion if you violate these Terms or engage in unlawful activities.
2. Account Registration
- To use the App, you may need to create an account. When registering, you agree to provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account.
3. Data Collection and Privacy
- The App collects personal data as described in our Privacy Policy. By using the App, you consent to the collection and use of your data as outlined in the Privacy Policy.
- We use your data to provide app services, including accessing glucose readings through Third-Party services such as Dexcom, processing well-being data from questionnaires, and storing account information in Azure.
- Anonymized and aggregated data may be used for research purposes, as described in the Privacy Policy.
4. Health and Well-Being Information
- The App provides insights based on glucose data from third-party services such as Dexcom and well-being data from questionnaires. However, the App is not a substitute for professional medical advice, diagnosis, or treatment.
- You should consult a healthcare provider for any health concerns or questions regarding your glucose levels or well-being.
- We are not responsible for any decisions you make based on the information provided by the App.
5. Intellectual Property
- All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Researchable.
- You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or reverse-engineer any part of the App without our prior written consent.
6. Third-Party Services
- The App integrates with third-party services such as the Dexcom API. These third-party services are governed by their own terms and conditions, and we are not responsible for the practices or policies of these third parties.
- By connecting your third-party account, you agree to comply with their terms and conditions.
7. Research and Development
With your explicit consent, we may use anonymized or aggregated data for research purposes, including collaboration with academic and medical institutions.
No personally identifiable information will be shared in research publications or studies. Any use of your data for research will comply with applicable privacy laws, as outlined in our Privacy Policy.
8. Limitation of Liability
- The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
- To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee that the App will be error-free, secure, or available at all times. We are not responsible for any damages arising from your use of the App, including but not limited to any direct, indirect, incidental, or consequential damages.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of your use of the App, your violation of these Terms, or your infringement of any third-party rights.
10. Modifications to the App and Terms
- We reserve the right to modify or discontinue the App, or any part of it, at any time without notice.
- We may also modify these Terms at any time. Changes to the Terms will be effective immediately upon posting, and your continued use of the App constitutes your acceptance of the updated Terms.
11. Governing Law
- These Terms are governed by and construed in accordance with the laws of the state of California, USA, without regard to its conflict of law provisions.
- Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts located in California.
